Social Security law allows disabled persons to file for and receive disability benefits.  However, individuals often file the initial claim and later have difficulty receiving benefits.  When a disability claim is denied, persisting through the reconsideration and appeals process proves difficult for the average citizen to navigate.

The appeals process for a disability claim in Los Angeles
The law allows disabled people to file a claim for financial support.  However, often claims are denied and a complex and time-consuming appeals process begins that may require legal guidance to prevail.  The appeals process begins on a denied claim with reconsideration.

Reconsideration is the re-examination of evidence at a hearing before a disability hearing officer.  After the hearing, a written decision is issued with an explanation of findings.  If denied at the reconsideration stage a hearing before the Administrative Law Judge (ALJ) may be requested.

During the ALJ hearing, a claimant presents new evidence and expert witnesses.  After the ALJ hearing a written decision is issued that includes one of the following determinations:

- Fully favorable—finds fully for the claimant
- Partially favorable—finds claimant was disabled, but with date discrepancies and/or disabled, but improved
- Unfavorable—finds claimant was not disabled

If a partially favorable or unfavorable decision is received, a claimant may file an appeal to the Social Security Appeals Council in Virginia through a written brief.
